SORAGHAN CONSTRUCTION LLC ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional single-family housing construction, custom home building, and general contracting services. By requesting a project estimate, communicating with us, or authorizing site work, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, except where a separate written construction agreement governs a specific project.
We provide professional general contracting services specifically focused on single-family residential construction. This includes, but is not limited to: custom home building, structural framing, foundation work, room additions, and exterior property improvements. The specific project scope, architectural blueprints, materials specifications, pricing, and Connecticut statutory warranties will be defined exclusively in a separate, fully executed written construction contract or change order.
Unless otherwise stated in writing, initial residential construction estimates provided by our team are valid for 30 days from the date issued. Estimates are based on visual site inspections and information reasonably available at the time. Final costs may change due to concealed or unforeseen structural/soil conditions discovered during excavation (e.g., hidden water tables, ledge rock), permit requirements, changes in lumber pricing, or client-requested upgrades. Any material deviations require a formal, written change order approved by the Client before additional work proceeds.
Clients are strictly responsible for funding their construction projects according to the payment schedule and milestone terms contained in their specific construction agreement. Deposits are generally required before our crews begin ordering custom materials (e.g., cabinetry, structural steel, windows) or scheduling specialized trade subcontractors. In accordance with state law, we reserve the right to suspend work for materially delinquent payments and may apply a statutory mechanic's lien under Connecticut law to the property for unpaid contracting fees, labor, or building materials.
The Client agrees to provide the Company's carpentry crews, tradesmen, subcontractors, and municipal inspectors with reasonable, safe, and unobstructed access to the property during scheduled working hours. The Client is strictly responsible for securing personal belongings, keeping pets indoors, and ensuring that children remain clear of the active construction zone prior to our daily arrival.
Project schedules and construction milestones are approximate unless expressly guaranteed in a separate written agreement. The Company shall not be responsible for delays caused by circumstances beyond its reasonable control, including severe New England weather conditions (e.g., heavy snow, freezing rain, or Nor'easters affecting exterior framing and foundation pours), material supply chain shortages, delays by local municipal building inspectors, or unmarked utility conflicts.
During active construction, Clients and their representatives must maintain a safe distance from our heavy machinery, power tools, open trenches, and active structural framing zones at all times. Unescorted visits to the active jobsite are strictly prohibited to comply with OSHA safety regulations and liability reasons. All construction equipment provided by the Company is to be operated exclusively by our trained staff.
You agree to accurately identify property lines and provide complete information reasonably necessary for the Company to perform the services. Crucially, the Client is responsible for disclosing the location of all private underground utilities (e.g., invisible dog fences, private septic lines, landscape lighting) prior to any exterior excavation or foundation work. We will contact Connecticut Call Before You Dig (CBYD 811) for public utility locates as required by law prior to major earthwork.
To the fullest extent permitted by applicable law, SORAGHAN CONSTRUCTION LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use or our general contracting services. Our total liability relating to a specific residential construction project is strictly limited to the applicable written project agreement and applicable law.
If you voluntarily opt-in to receive text messages from us, you agree to receive automated SMS/MMS messages
strictly for operational project management, construction schedule updates, and customer service communications.
We do not use text messaging for marketing or promotional campaigns.
Operational message examples include: "SORAGHAN CONSTRUCTION: The municipal building inspector has approved the foundation pour for your new home today."
Message frequency varies based on the active phase of your construction project. Message and data rates may apply. Consent is completely voluntary and is explicitly non-mandatory; opting out will not affect your ability to secure our residential construction services. You may withdraw your consent at any time by replying STOP. For help, reply HELP.
We strictly protect your mobile data. We do not share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, material suppliers, or external subcontractors for any purpose.
Unless otherwise agreed in writing, architectural floor plans, 3D renderings, proposals, designs, and project photography created by SORAGHAN CONSTRUCTION LLC remain the exclusive intellectual property of the Company. Clients may not reproduce, distribute, or use proprietary materials for another project or third-party contractor without the Company's express written permission.
These Terms and Conditions and all residential construction contracts shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state and federal courts located in Litchfield County, Connecticut.
You agree to fully indemnify and hold harmless the Company, its crews, and staff from any claims, losses, damages, or liabilities arising from your material misrepresentation of property boundaries, structural history, or failure to disclose known private underground utilities prior to excavation. If any provision of these Terms is found to be unenforceable, it shall be limited to the minimum extent necessary so that the remainder of these Terms continues in full force and effect.
